Welcome to ARETI.
These Terms of Service ("Terms") govern your access to and use of the ARETI website, online store, products and related services (collectively, the "Services").
In these Terms, "ARETI", "we", "us" and "our" refer to ARETI.
Our store is hosted by Shopify, which provides us with the online commerce platform that allows us to sell our products to you.
Please read these Terms carefully before using our website or purchasing from us. By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy.
If you do not agree with these Terms, please do not use our website or Services.
1. ELIGIBILITY AND USE OF OUR WEBSITE

You agree to provide information that is accurate, current and complete when making a purchase or otherwise providing information to us.

We make every reasonable effort to ensure that product descriptions, photographs, colours, dimensions and other information displayed on our website are accurate and up to date.
However, colours and appearance may vary depending on your device, screen settings and other factors. Product images are provided for illustrative purposes and minor variations may occur.
Where product measurements are provided, they are intended as a guide. Please refer to the individual product listing for specific product information.
Our jewellery may naturally change in appearance over time through normal wear and exposure to environmental factors. Proper care can help maintain the appearance and finish of your jewellery.

Nothing in these Terms excludes, restricts or modifies any rights or remedies you may have under the Australian Consumer Law or other applicable laws that cannot lawfully be excluded, restricted or modified.
3. AUSTRALIAN CONSUMER LAW
Nothing in these Terms is intended to exclude, restrict or modify your rights under the Australian Consumer Law or any other applicable law that cannot lawfully be excluded, restricted or modified.
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.
You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.
You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
These consumer guarantees apply automatically and are separate from any voluntary warranty or returns policy we may offer.

4. ORDERS
When you place an order through our website, you are making an offer to purchase the products in your order.
An order is not considered accepted until we have processed the order and accepted your payment.
We reserve the right to decline or cancel an order where reasonably necessary, including where:
- a product is unavailable;
- there is an error in the product description or pricing;
- we reasonably suspect fraudulent or unauthorised activity;
- we are unable to fulfil the order; or
- an order otherwise breaches these Terms.
If we cancel an order after payment has been received, we will refund the amount paid for the cancelled order.
We will endeavour to contact you using the contact information provided with your order if we need to cancel or make changes to an order.
Once an order has been accepted and processed, we may not be able to accommodate cancellation requests. This does not affect any rights you may have under the Australian Consumer Law or our Refund & Returns Policy.
5. RETURNS, REFUNDS AND EXCHANGES
Our returns, refunds and exchanges are handled in accordance with our Refund & Returns Policy, which forms part of these Terms.
Please review our Refund & Returns Policy before making a purchase.
Nothing in our Refund & Returns Policy or these Terms limits your rights under the Australian Consumer Law.
Where a product has a fault or does not meet an applicable consumer guarantee, we will provide the remedy required by law.
6. JEWELLERY CARE
To help maintain the appearance and finish of your jewellery, we recommend:
- removing jewellery before showering, swimming or exercising;
- avoiding prolonged exposure to water, salt water and chlorine;
- applying perfume, lotions, oils and beauty products before putting on jewellery;
- avoiding direct contact with harsh chemicals and cleaning products;
- storing jewellery in a dry place when not being worn; and
- gently cleaning and drying jewellery as recommended in our Jewellery Care information.
Jewellery may naturally experience changes in appearance and finish through normal use and exposure to environmental factors.
Care instructions are provided to help you maintain your jewellery and do not limit or exclude any rights you may have under the Australian Consumer Law.
7. PRICES AND PAYMENT
All prices displayed on our website are in Australian dollars unless otherwise stated.
Prices, products, discounts and promotions may change from time to time.
The price charged for a product will generally be the price displayed at the time your order is placed, as confirmed in your order confirmation.
We reserve the right to correct genuine pricing, product or promotional errors.
If an error has materially affected an order you have placed, we will contact you as soon as reasonably practicable and, where appropriate, provide you with the option to confirm the corrected order or cancel the order and receive a refund.
You agree to provide accurate and complete payment and billing information.
You confirm that you are authorised to use the payment method provided for your purchase.
Payment processing is handled through our payment providers and may be subject to their own terms and conditions.
8. SHIPPING AND DELIVERY
We aim to process and dispatch orders within the processing timeframe stated on our website or Shipping Policy.
Delivery timeframes are estimates and may vary depending on the delivery provider, destination, public holidays, customs processing, weather, unforeseen events or other circumstances outside our reasonable control.

If your order is delayed, appears to be lost, or arrives damaged, please contact us at aretihq@outlook.com as soon as reasonably possible so that we can assist you.
You are responsible for providing an accurate and complete delivery address.
If an order is returned to us because an incorrect or incomplete address was provided, we may contact you to arrange further delivery.
Nothing in these Terms excludes or limits any rights or remedies you may have under the Australian Consumer Law.
9. INTELLECTUAL PROPERTY
All content available through our Services, including but not limited to our brand name, logo, product names, photographs, product images, graphics, designs, text, website content and other materials, is owned by or licensed to ARETI and is protected by applicable intellectual property laws.
You may access and use our website for your personal, non-commercial purposes.
You must not, without our prior written permission:
- copy or reproduce our content;
- modify or create derivative works from our content;
- reproduce or use our photographs or product images for commercial purposes;
- distribute or republish our content;
- use our branding, logo or trademarks;
- scrape or systematically collect content from our website; or
- otherwise exploit our intellectual property for commercial purposes.
All rights not expressly granted to you are reserved by ARETI.
10. THIRD-PARTY SERVICES AND LINKS

These third-party services may operate independently from ARETI and may be subject to their own terms and privacy policies.
We are not responsible for the content, availability, accuracy, security or practices of third-party websites or services that we do not control.

11. SHOPIFY
Our store is hosted by Shopify, which provides the online commerce platform that allows us to sell our products and provide our Services.
Any purchases made through our store are transactions between you and ARETI.
Shopify is not responsible for the products we sell, our returns or refunds, or the fulfilment of orders placed through our store.
Your use of Shopify's services may also be subject to Shopify's own terms and policies.

Personal information collected through our Services is handled in accordance with our Privacy Policy.
By using our Services, you acknowledge that you have read our Privacy Policy.

13. REVIEWS AND CUSTOMER FEEDBACK
If you submit a review, testimonial, photograph, comment, suggestion or other content to us ("Feedback"), you grant ARETI a non-exclusive, worldwide, royalty-free licence to use, reproduce, publish, display and distribute that Feedback for the purpose of operating, promoting and improving our Services and brand.
You represent that you have the necessary rights to any Feedback you submit and that your Feedback does not infringe the rights of another person.
You must not submit Feedback that is unlawful, misleading, defamatory, abusive, threatening, obscene or otherwise inappropriate.

To the maximum extent permitted by law, ARETI will not be liable for loss or damage arising from your use of our website or Services where such liability may lawfully be excluded.
However, nothing in these Terms excludes, restricts or modifies:
- your rights under the Australian Consumer Law;
- any liability that cannot lawfully be excluded or limited; or
- any rights or remedies available to you under applicable law.
Where liability may legally be limited, ARETI's liability will be limited to the extent permitted by law.
19. INDEMNIFICATION
To the extent permitted by law, you agree to indemnify ARETI against reasonable losses, liabilities, claims and expenses arising from your:
- breach of these Terms;
- unlawful use of our Services;
- infringement of another person's rights; or
- intentional or negligent misuse of our website or Services.
This section does not require you to indemnify ARETI for loss caused by ARETI's own unlawful conduct or to the extent that such an indemnity would be prohibited by law.
20. SEVERABILITY
If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be interpreted or modified to the minimum extent necessary to make it lawful and enforceable.
If it cannot be made enforceable, the relevant provision will be severed without affecting the validity of the remaining provisions.

If we do not immediately enforce a provision of these Terms, this does not mean that we waive our right to enforce it later.
These Terms, together with our Privacy Policy, Refund & Returns Policy, Shipping Policy and any other policies expressly incorporated into these Terms, constitute the agreement between you and ARETI regarding your use of our Services.
Nothing in these Terms limits any rights you may have under applicable law.
22. ASSIGNMENT
You may not transfer or assign your rights or obligations under these Terms without our prior written consent, except where permitted by law.
We may transfer or assign our rights and obligations under these Terms where reasonably necessary in connection with the operation, restructuring or sale of our business, subject to applicable law.
23. GOVERNING LAW
These Terms are governed by the laws of New South Wales, Australia.
You and ARETI submit to the non-exclusive jurisdiction of the courts of New South Wales, Australia, and any courts competent to hear appeals from those courts.
Nothing in this section prevents you from exercising any rights or remedies available to you under applicable Australian consumer law.
24. CHANGES TO THESE TERMS
We may update these Terms from time to time.
The most current version of these Terms will be available on this page and will show the date of the most recent update.
Where required by law, we will provide notice of material changes.
Your continued use of our Services after updated Terms have been published constitutes acceptance of the updated Terms to the extent permitted by law.
